Terms of Service

By accessing or using the Voltex Ventures website at voltexventures.com, client portal at portal.voltexventures.com, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Services. These Terms apply to all visitors, clients, and others who access or use the Services.

Voltex Ventures provides website design, development, and ongoing maintenance services for local service businesses, including pool service, HVAC, plumbing, and real estate businesses. Our Services include: • Custom website design and development • Search engine optimization (SEO), answer engine optimization (AEO), and generative engine optimization (GEO) • Lead capture forms and lead management dashboard access • Ongoing monthly website updates and maintenance • Business messaging and communication services Service terms, deliverables, and pricing are agreed upon in writing between Voltex Ventures and each client prior to project commencement.

By submitting your phone number or contact information through any Voltex Ventures form, you consent to receive communications from Voltex Ventures, including: • SMS text messages regarding your inquiry, proposal, or project status • Appointment and follow-up reminders • Service updates and notifications Message frequency varies based on your engagement with our services. Standard message and data rates may apply. To opt out of SMS communications, reply STOP to any text message at any time. After opting out, you will receive one confirmation message and no further SMS communications. For help, reply HELP or email hello@voltexventures.com. We use Meta's business messaging platform to communicate with users who initiate contact via Facebook or Instagram. By messaging us through those platforms, you agree to Meta's terms of service in addition to these Terms.

When using our Services, you agree to: • Provide accurate and complete information when submitting forms or requesting services • Not use the Services for any unlawful purpose or in violation of any applicable laws • Not attempt to gain unauthorized access to any portion of the Services or related systems • Not reproduce, duplicate, copy, sell, or exploit any portion of the Services without express written permission from Voltex Ventures • Not transmit any harmful, offensive, or disruptive content through our messaging channels

Access to the Voltex Ventures client portal at portal.voltexventures.com is granted only to authorized clients via invitation. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@voltexventures.com if you suspect any unauthorized use of your account. Voltex Ventures is not liable for any loss or damage arising from unauthorized access resulting from your failure to protect your credentials.

Website build fees are due as agreed in the client proposal. The ongoing monthly maintenance fee is billed on a recurring basis. The monthly rate in effect at the time of your initial agreement is locked for the lifetime of your active subscription. You may cancel the monthly subscription at any time. Upon cancellation, monthly services will continue through the end of the current billing period. The one-time build fee is non-refundable after site delivery and approval, except as stated in our satisfaction guarantee. Satisfaction Guarantee: If we are unable to deliver a website you are satisfied with within 14 days of project commencement, we will refund your build fee in full.

Upon full payment of the one-time build fee, you own the content, copy, and design assets specific to your website. Voltex Ventures retains the right to display your website in our portfolio as an example of our work unless you request otherwise in writing. Voltex Ventures retains ownership of any proprietary code, frameworks, or tools developed independently and used in delivering your website. The Voltex Ventures name, logo, and brand are the exclusive property of Voltex Ventures and may not be used without written permission.

Our Services may integrate with or rely on third-party platforms including but not limited to Supabase (database), Resend (email delivery), Vercel (hosting), Google Analytics, and Meta's business messaging platform. Your use of these integrations is subject to those platforms' respective terms of service and privacy policies. Voltex Ventures is not responsible for the availability, accuracy, or conduct of third-party services.

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. Voltex Ventures does not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee specific rankings in search engines or placement in AI-generated responses. SEO, AEO, and GEO results depend on many factors outside our control.

To the fullest extent permitted by applicable law, Voltex Ventures shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Services — including but not limited to lost profits, lost data, or business interruption. Our total liability to you for any claim arising from the Services shall not exceed the amount you paid to Voltex Ventures in the three months preceding the claim.

Either party may terminate the monthly service subscription at any time with written notice. Voltex Ventures reserves the right to suspend or terminate access to the Services at any time for violation of these Terms, non-payment, or conduct that we determine to be harmful to other users or to Voltex Ventures. Upon termination, your right to use the Services ceases. Sections regarding intellectual property, limitation of liability, and governing law survive termination.

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles. Any disputes arising from these Terms or the Services shall be resolved in the courts located in Davidson County, Tennessee.

We may update these Terms from time to time. When we do, we will revise the effective date below. Continued use of the Services after updated Terms are posted constitutes your acceptance of the revised Terms. We will make reasonable efforts to notify active clients of material changes.
